Tariff-Rate Quotas in Chapter 99: The 73 Provisions Where Timing Beats Negotiation
Computed from ExportSonar's machine-readable HTS extract (23,193 active lines, USITC REST export generated 2026-10-09) and our Chapter 99 trade-measure corpus (637 rows); every figure in this guide is reproducible from those datasets.
Most of Chapter 99 is about stacking: extra duties bolted onto a base rate, as our stacked-tariffs guide documents. But a distinct minority of the chapter works completely differently. It does not add percentages — it sells access. Our extract counts 73 quota-type provisions among the 637 chapter-99 rows (11.5%): legal doors through which a product may enter at a reduced or unchanged rate only if the shipment arrives inside a quantity window during a calendar period. Miss the window and the door slams: the same product, described identically, pays a multiple of the rate. These are the provisions where timing beats negotiation — no discount with a supplier changes the number, but arriving three days late doubles it.
The four administrative families, counted
| Family (measure field, verbatim) | Provisions | Prefixes | What it actually is |
|---|---|---|---|
| USTR quota-period allocation | 33 | 9903.17, 9903.18 | Entry permitted only under the first, second … nth quota period declared in a USTR notice — the calendar is the compliance object |
| USDA special limited global quota | 27 | 9903.52 | Cotton and related agricultural purchases entered pursuant to the Secretary of Agriculture's Special Limited Global Import Quota Announcement |
| Tariff-rate quota (U.S. note 18) | 11 | 9903.45 | The solar safeguard family: photovoltaic cells, modules, bifacial panels and quartz surface products with in-quota and out-of-quota rate cells |
| Tariff-rate quota (U.S. note 3) | 2 | 9903.54 | Argentina beef: an additional 80,000-metric-ton tranche on top of the note 3(a) annual aggregate, with its own statutory window |
Source: our Chapter 99 extract (data/trade_remedy.json), rows whose measure field names a quota mechanism; every figure on this page is recomputed from that file at build time. All 73 sit under prefix 9903.
Two structural facts make this family operationally unlike anything else in the schedule. First, not one of the 73 provisions carries an effective date in our machine-readable extract — the schedule points to notes and agency notices because the quantities and periods move year to year. Second, the general column is usually silent: 60 of the 73 rows print nothing at all in the general column; 6 read “No change” (entry proceeds under the base heading's rate provided the quota terms are met) and only 7 state an explicit percentage — 14%, 25%, 30% on four lines, and 50%. A filer who reads only the row sees an empty cell where the money question lives.
The cliffs: in-quota versus out-of-quota, measured
| Product lane | In-quota line | In rate | Out-of-quota (“Other”) | Out rate | Base heading for comparison |
|---|---|---|---|---|---|
| Crystalline silicon PV cells/modules, within quarterly cap of 300,000 units (note 17(i)) | 9903.45.01 | 14% | 9903.45.02 | 30% | 8541.42.00 — Free |
| Quartz surface products (U.S. note 41(a)), within note 41(d) quantity | 9903.45.30 | 25% | 9903.45.31 | 50% | 6802.91 family — 2.5–4.9% across five lines |
Source: general columns of each provision in our Chapter 99 extract, cross-checked against base-heading rates in the HTS extract (data/hts.json), where ordinary stone articles under 6802.91 span 2.5–4.9% and photovoltaic cells under 8541.42 enter Free.
Read the last column again: the underlying goods sometimes enter free. The entire commercial exposure is created by the quota overlay. Quartz surface products — engineered stone countertops and slabs — pay 2.5% to 4.9% as ordinary stone articles, yet the safeguard layer charges 25% inside the quota and doubles to 50% outside it. On a $10,000 consignment that is $2,500 versus $5,000 in duty for the identical product description; the only variable that changed is the entry date relative to the note 41(d) quantity. The solar ladder behaves the same way: 14% within the 300,000-unit quarterly cap, 30% for the Other basket — against a base schedule line that is Free.
Solar is also where the archaeology shows
Quota layers accumulate sediment. Provision 9903.45.22 still prints a 30% rate, but its description carries the compiler's note that the subheading and its governing note 18 have expired (see 87 Fed. Reg. 7357). Meanwhile 9903.45.29 carves bifacial panels out of the burden entirely when they meet the note 18(j) absorption conditions, and 9903.45.25 prices modules differently when the product originates in countries covered by other arrangements. A single family, three different regimes, all sharing nine digits of prefix. This is why we keep reminding readers that the ten-digit suffix — and here even the chapter-99 provision number — is the thing that binds: see our statistical suffix guide.
A worked example: Argentina beef's 80,000 metric tons
Provision 9903.54.01 is a masterclass in how specific quota law gets. Verbatim, beyond the note 3(a) annual aggregate for beef of Argentina, “an additional 80,000 metric tons of lean beef trimmings of Argentina may be entered for consumption, or withdrawn from warehouse for consumption, between 12:01 a.m. local port time on February 13, 2026, and 11:59 p.m. eastern time on December 31, 2026” — and only under four named statistical reporting numbers (0201.30.5091, 0201.30.5097, 0202.30.5091, 0202.30.5097). Every element of that sentence is a filing decision: the product form (lean beef trimmings), the origin, the four ten-digit codes, the two clocks (local port time opens the window; eastern time closes it). Miss the interaction — say, entering under a sibling statistical line — and the additional tranche simply is not available to you, whatever the broker expected.
Why administration, not negotiation, decides these dollars
For everything else in the schedule, an importer controls the rate through classification and valuation. Quota provisions invert the control loop: the rate is fixed, the quantity is fixed, and the only strategic variable is when the goods arrive and whether the paperwork matches the announcement that opened the window. That is why these 73 rows reward monitoring infrastructure the way continuous-review inventory policies reward demand forecasting:
- Period allocations reset on agency notices — the 33 USTR lines exist purely to receive successive quota periods; whoever watches the Federal Register notice moves first.
- USDA announcements govern 27 agricultural lanes — raw cotton under 5201 (general column up to 31.4¢/kg on the residual non-preferential line) flows through the Secretary's Special Limited Global Import Quota Announcement, not through the schedule text.
- Windows have hard edges — the Argentina beef tranche opened February 13, 2026 and closed December 31, 2026, to the minute, in two different time conventions.

Frequently asked questions
- What is a Chapter 99 tariff-rate quota provision?
- It is an add-on line of the US schedule that conditions a duty outcome on a quantity and a calendar window: if your shipment enters inside the allotted quantity during the defined period, one rate applies; outside it, another does. Our extract counts 73 such provisions across five prefixes (9903.17, 9903.18, 9903.45, 9903.52 and 9903.54), which is 11.5% of all 637 chapter-99 rows.
- How many quota provisions live in Chapter 99 right now?
- Seventy-three, split into four administrative families: 33 USTR quota-period allocation lines, 27 USDA special limited global quota lines, 11 tariff-rate quota provisions under U.S. note 18 (the solar safeguard family) and 2 under additional U.S. note 3 (Argentina beef). Not one of the 73 carries an effective_date field in our machine-readable extract, which is precisely why the calendar has to be tracked from agency notices rather than the schedule text alone.
- What happens if I enter after the quota window closes?
- You fall into the Other basket of the same provision and the rate jumps. For crystalline-silicon photovoltaic cells and modules the in-quota line 9903.45.01 carries 14% while the out-of-quota Other line 9903.45.02 carries 30%; for quartz surface products the cliff runs from 25% (9903.45.30) to 50% (9903.45.31). On a $10,000 quartz consignment the difference is $2,500 in duty for the identical product description.
- Where is the actual duty rate printed for a quota provision?
- Often nowhere in the row itself. Sixty of the 73 quota provisions print nothing in their general column; the operative rate lives in the governing U.S. note or in annual agency quota announcements. Only 13 carry any general-column text at all: 7 state a percentage (14%, 25%, 30% four times over, 50%) and 6 read No change, meaning entry proceeds under the base heading's rate if the quota terms are met.
